MINUTES OF THE PUBLIC MEETING OF MARCH 9TH, 2004
HANSON TOWN HALL, LIBERTY ST., HANSON, MA

Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

        Motion to accept the minutes of February 24, 2004 as written:  Amy Gardner

Public Hearings

7:45 PM  Abbreviated Notice of Intent for construction of four (4), two-bedroom, single family units and parking lot with twelve parking spaces, the rear only of parking lot (approx. 312 sq.ft) in the 100-foot buffer zone at Elm St., Assessor’s Map 36, Lots 8-1R & 8-2R for Donald Shute, 345 Washington St., Pembroke, owner. (DEP #175-)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Robert Ocko of Chilmark Co., Inc. and Donald Shute presented plans showing the situation of the buildings and parking spaces.  A small portion of the parking lot would be within the 100-foot buffer zone.   Depending on soil conditions, the well could also be within the 100-foot buffer.  A site visit was made by the agent and Ron Grattan on March 7th to check the wetland delineation.   

Motion to continue the hearing to April 13, 2004 pending the issuance of a DEP#:  Amy Gardner

8:00 PM  Request for Determination for a septic repair at 23 Monroe St., Assessor’s Map 32, Lot 10,  for Robin and Stephen Curran represented by Al Vautrinot of Vautrinot Land Surveying, P.O. Box 144, Plympton, MA.

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Al Vautrinot presented revised plans showing a change in haybale location.  The current system is a failed

cesspool.    The new system is Board of Health approved and will fit into the side of a hill with a natural grade.  It is out of the 50-foot buffer zone.

8:15 PM  Abbreviated Notice of Intent for proposed construction of an addition to an existing dwelling at 56 Indian Path, Assessor’s Map 62, Lot 12-18 for Don Weber, represented by D.J. Construction, 49 Lorraine St., Weymouth, MA  02189.  (DEP #175-)

Craig Nicholson read the Public Hearing Notice.  The abutter’s list needed to be clarified.   Don Jones of DJ Construction and Mr. Weber presented plans showing an in-law addition that is out of the 50-foot no build zone.  Ms. Cassady has made a site visit and checked the wetland delineation done by Sharon LaPorte.   Mr. Lindquist read off the abutter’s list.  Those present were:

Stephen Keddy, 49 Indian Path asked how a wetland line was established.  Ms. Cassady answered that in this case, plant identification was used to help make that determination.
Robert Duff of 62 Indian Path had no comments.
Michael Hulak of 51 Indian Path had no comments.

8:45 PM Abbreviated Notice of Resource Area Delineation for confirmation of the wetland line across from 670 Pleasant Street, Assessor’s Map 8, Lot 11-1 for Development South Realty Trust, 169 Summer St., Kingston, MA represented by Vautrinot Land Surveying, Inc., P.O. Box 144, Plympton, MA  (DEP #175-423)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Al Vautrinot and Joan Meary of South Shore Housing Development Corp. presented a plan showing the wetland delineation done by Joe Stigliani.  In addition, the plan showed the location of a possible vernal pool.  Mr. Lindquist read off the abutter’s list and asked for questions or comments.  Those present were:

Michael King, 681 Pleasant St. – Mr. King thought that the exact location of the vernal pool on the plan was incorrect.  He had concerns with standing water in one of the corners of the lot.  He believes that the river is perennial and that the land is situated on an aquifer.
Stephen Shangold, 631 Pleasant St. – Mr. Shangold had same concerns with standing water.  Also, there is water in the street after heavy rains.
Deborah Lewis, 684 Pleasant St. – no comments
Andrew Steele , 642 Pleasant St. – same concerns with water.

A site visit was scheduled for Saturday, April 3rd at 10AM.

Appointments

8:30 PM  Continuation of a discussion with Don Ellis, regarding a Superseding Order of Conditions issued by the DEP for the Union Street property.  (DEP #175-369)
Ms. Cassady read the by-law regarding variances and buffer strips to the Board.  The Board also looked at the previous proposed plot plan and the paperwork referencing the year that the lot was recorded (1951).  There was a consensus that the Board would reconsider it’s denial of Mr. Ellis’s proposal.  He would need to re-advertise for a new hearing date and re-notify abutter’s of a new hearing.  Ms. Cassady will notify Town Counsel.

Open Space

 In regards to the Lakeside Road property that the owners have indicated is for sale, Ms. Cassady has written to notify them of Conservation Commission’s interest in acquiring the

property if possible through the Agricultural Preservation Restriction Program.  The land is in Chapter 61A which is a tax-incentive program whereby the Town gets the right of first refusal.  
Mr. Lindquist would like a list of Chapter 61A properties in town so that we are aware of potential open space that would be of interest to Conservation.

Ms. Cassady stated that she is meeting with owners of Lite Control at 10 AM tomorrow.

It was decided that since the abutter’s list was found to be incomplete after the fact, the hearing for 116 Woodman Terrace would be re-heard on April 13th.   Ms. Cassady will notify the Engineering Company of James Engineering, Inc., 125 Great Rock Rd., Hanover, MA and the owner Phillip Beaulieu.  The hearing will be re-advertised and certified abutters will be notified.
